CAVEAT AND NOTICE OF LIS PENDENS IN RESPECT OF LAND FORMING PART OF PADOPADS HARMONY SECONDARY SCHOOL SITUATE AT OLD OTUKPO ROARD, BESIDE BENUE PRINTING, MAKURDI

We are Solicitors to Barr. Placida Teradzungwe Awunah (hereinafter referred to as Our Client) on whose brief and instructions we write in respect of the above captioned.

2. Our client informed us that she is one of the children of the late Chief Hon. Pius Dooga Awunah, popularly known as Chief Padopads Awunah.

3. It has come to the knowledge of our client that the vast land forming part of Padopads Harmony Secondary School Land, Makurdi has been encroached upon by some persons after being misled by some members of the late Chief Hon. Pius Dooga Awunah family who also misled Ministry of Lands and Survey into surveying and partitioning the land for sale without recourse to other principal members of the late Chief Hon. Pius Dooga Awunah family.

4. Disturbed by the brazen encroachment on the Padopads Harmony Secondary School Land, our client has filed Suit No. MHC/129/2025 before the High Court of Benue State challenging the activities of the trespassers, which suit is still pending, and an order of injunction restraining anybody from interfering with the properties of late Chief Hon. Pius Dooga Awunah covered by State Certificates of Occupancy Nos: BN 8029 issued to Pius Dooga Awunah, BN 5804, issued to Pius D. Awunah, and Makurdi Local Government certificate of Occupancy No. 5 issued to Padopads Harmony Secondary School, Makurdi has been obtained. Any person who buys or carries out any transaction on the Padopads Harmony Secondary School Land or any of the properties in the name of Pius Dooga Awunah which are the subject of a determination of the court, exposes himself/herself to a probable trouble, since the outcome may be against the vendor.

5. In view of the above, we have the instructions of our client to request your esteemed office to place a caveat on all the properties of late Chief Hon. Pius Dooga Awunah including properties covered by State Certificates of Occupancy Nos: BN 8029 issued to Pius Dooga Awunah, BN 5804, issued to Pius D. Awunah, and Makurdi Local Government certificate of Occupancy No. 5 issued to Padopads Harmony Secondary School Land, Makurdi and not to survey, partition or process any title document or entertain or register any Power of Attorney, transfer or transaction relating to the land in question in favour of any other person, corporate or individual, or even lift the said caveat without a written instruction from our client.

6. We further request that if any title is being processed in respect of the above lands in the name of any other beneficiary, it should be stopped forthwith and we should be notified.
